These Terms & Conditions govern your use of the Peekabl platform. Please read them carefully. By creating an account or accessing any part of the platform, you agree to be bound by these terms. If you do not agree, do not use Peekabl.
1. About Peekabl
Peekabl is a live, host-led virtual travel and experience streaming platform. It enables users to explore places, cultures, and experiences around the world through real-time interactive streams hosted by verified local hosts.
1.1 Legal Entity
Peekabl is operated by CU DPK, a company registered in Bulgaria ("Peekabl", "we", "us", or "our"). Our registered address and contact details are available at peekabl.com/legal.
1.2 Platform Description
The Peekabl platform includes:
- The peekabl.com website and any associated subdomains
- Mobile applications available on iOS and Android
- Any APIs, tools, or integrations made available to users and hosts
- All content, features, and services offered through the above (collectively, the "Platform")
1.3 Relationship Between These Terms and Other Policies
These Terms & Conditions ("Terms") form the main agreement between you and Peekabl. They should be read together with:
- Our Privacy Policy — how we collect, use, and protect your personal data
- Our Cookie Policy — how we use cookies and tracking technologies
- Our Community Guidelines — conduct standards for all Platform participants
- Our Payment and Refund Policy — billing, subscriptions, and refund terms
- Our Host Agreement — additional terms applicable to hosts (if you are registered as a host)
In case of any conflict between these Terms and another policy, these Terms take precedence unless a specific policy expressly states otherwise.
2. Eligibility and Account Registration
2.1 Age Requirement
You must be at least 18 years old to create a Peekabl account or use the Platform. By registering, you confirm that you meet this requirement. Peekabl does not knowingly allow users under 18 to access the Platform. If we become aware that a user is under 18, we will close that account immediately.
2.2 Account Creation
To access most features of Peekabl, you must create an account. When registering, you agree to:
- Provide accurate, complete, and current information
- Maintain and promptly update your account information
- Use a valid email address that you control
- Create a secure password and keep it confidential (if required)
You may register directly with your email address or through a supported third-party authentication provider (such as Google). If you use a third-party provider, their terms and privacy policies also apply to that authentication.
2.3 One Account Per Person
Each user may hold one active account. Creating multiple accounts to circumvent restrictions, bans, or platform policies is prohibited and may result in termination of all associated accounts.
2.4 Account Security
You are responsible for all activity that occurs under your account. You must:
- Keep your login credentials confidential
- Not share your account with any other person
- Notify us immediately at legal@peekabl.com if you suspect unauthorized access to your account
Peekabl will not be liable for losses arising from unauthorized use of your account where you have failed to take reasonable steps to protect your credentials.
2.5 Username and Display Name
When creating your account, you may not use a display name or username that:
- Impersonates another person or entity
- Contains offensive, discriminatory, or unlawful language
- Uses the name of a public figure, brand, or institution in a misleading way
- Violates the intellectual property rights of any third party
Peekabl reserves the right to require you to change your username or display name at any time.
2.6 Payment Availability
Peekabl is built on the belief that curiosity, connection, and exploration should be available to everyone. We welcome users from all over the world. However, our ability to process payments is dependent on third-party payment service providers who operate under their own legal and regulatory obligations. In certain regions, our payment partners are legally restricted from processing transactions due to international financial regulations outside of Peekabl's control. Where this applies, paid features of the Platform may not be available to you.
If you are unable to complete a payment, this is likely due to a restriction imposed at the payment processing level rather than any decision by Peekabl to exclude you. We apologise for any inconvenience this causes and encourage affected users to contact us at support@peekabl.com — we will always do our best to find a solution where one is available.
3. Peekabl as a Marketplace Platform
3.1 Peekabl is a Marketplace Intermediary
Peekabl is a technology marketplace platform. Our role is to connect independent hosts with users who wish to participate in live virtual experiences. Peekabl provides the infrastructure, discovery tools, payment processing, and streaming environment that make these connections possible.
Peekabl does not itself create, design, lead, script, or control the content of any experience offered on the Platform. Each experience is independently conceived and delivered by the host who offers it. The contract for any individual experience is formed directly between the user and the host — Peekabl is not a party to that contract.
This marketplace structure is fundamental to how Peekabl operates. Users and hosts each acknowledge and accept this structure by using the Platform.
3.2 Hosts are Independent Contractors — Not Peekabl Employees or Agents
Hosts on Peekabl are independent contractors. They are not employees, workers, agents, partners, or representatives of Peekabl in any jurisdiction. Nothing in these Terms, the Host Agreement, or any other Peekabl document creates or is intended to create an employment, agency, or service provision relationship between Peekabl and any host.
Specifically:
- Hosts determine their own schedules. Peekabl does not assign working hours, require minimum availability, or dictate when a host must stream.
- Hosts determine the content and subject matter of their own experiences, subject to Peekabl's Community Guidelines and applicable law. Peekabl does not script, edit, or direct individual experience content.
- Hosts set their own pricing freely and independently. When a host sets a price, it is automatically classified into the appropriate experience tier based on that price point. The tier classification is a consequence of the host's own pricing decision, not a constraint imposed by Peekabl. Commission rates applicable to each tier are disclosed to hosts transparently before they publish any experience.
- Hosts are free to offer their services on other platforms simultaneously. Peekabl does not require exclusivity unless separately agreed in writing.
- Hosts are responsible for their own tax obligations, social contributions, insurance, and compliance with all laws applicable to them in their own jurisdiction. Peekabl does not withhold tax on behalf of hosts unless required to do so by mandatory applicable law.
Peekabl earns a platform commission on transactions facilitated through the Platform. This commission reflects our role as a marketplace operator, not as a service employer or labour intermediary. The existence of this commission, or of platform rules and guidelines that hosts must follow, does not alter the independent nature of the host relationship.
3.3 No Control Over Live Content — Platform Liability Limitation
Peekabl does not pre-screen, pre-approve, or pre-moderate the live content of individual streaming experiences before they are broadcast. Live streaming is real-time and unscripted by nature. It is technically and operationally impossible for Peekabl to review or control what a host says, shows, or does during a live session at the moment it occurs.
As a marketplace intermediary, and in accordance with applicable EU intermediary liability law including the Digital Services Act, Peekabl is not liable for third-party content transmitted through the Platform where we have no actual knowledge of its unlawful nature and act expeditiously to remove or disable it upon becoming aware.
Accordingly, Peekabl is not liable for:
- Statements, opinions, or information communicated by a host or user during a live experience
- The accuracy, completeness, or quality of any experience content
- Conduct by a host or user during a live session that violates these Terms or Community Guidelines
- Interactions between users and hosts that occur during or after an experience, whether on or off the Platform
- Any distressing, offensive, or harmful content that appears during a live stream before Peekabl has had a reasonable opportunity to respond
This limitation does not mean Peekabl is passive. We actively moderate reported content, investigate complaints, enforce our Community Guidelines, and reserve the right to terminate sessions, remove content, or suspend accounts immediately upon becoming aware of violations. Users and hosts are strongly encouraged to use our reporting tools during and after any session.
In accordance with Article 11 of the Digital Services Act, Peekabl designates a single point of contact for communications with national regulatory authorities and the European Commission on matters relating to the DSA. That point of contact is: trust@peekabl.com. Users may also use this address to report illegal content through our notice and action mechanism.
3.4 Host Verification — What It Does and Does Not Mean
Peekabl applies a verification process to hosts before they are permitted to list experiences. This includes identity checks and a review of the host's proposed experience against our baseline community standards.
Verification confirms that we have taken reasonable steps at the point of onboarding. It does not mean:
- That Peekabl endorses any specific statement, opinion, or view expressed by a host
- That Peekabl guarantees the quality, accuracy, or fitness for purpose of any experience
- That Peekabl has reviewed or approved the specific content of any individual live session
Users are encouraged to review host profiles, ratings, and past reviews before booking any experience.
3.5 Platform Availability
Peekabl makes reasonable efforts to ensure the Platform is reliable and accessible. However, we cannot guarantee uninterrupted access, the availability of any specific experience or host at any time, or identical functionality across all devices and locations. Planned maintenance will be communicated in advance where practicable. Our liability for Platform unavailability is governed by Section 10.
3.6 Third-Party Services
The Platform relies on third-party services including payment processors, streaming infrastructure, cloud hosting, and analytics tools. These providers operate under their own terms and policies. Peekabl selects providers with care but is not responsible for their independent performance, outages, or data handling practices beyond what is required by applicable law.
3.7 Your Assumption of Risk
By using Peekabl, you acknowledge that live virtual experiences are delivered in real time and depend on factors outside Peekabl's control. These include the host's local environment, weather, lighting, internet connectivity, power supply, and any physical or technical circumstances at the host's location. You accept that:
- Live experiences may be affected by conditions at the host's location that are not foreseeable or controllable by Peekabl
- The content and quality of an experience may vary from session to session and from what is described in a host's profile or listing
- Peekabl does not guarantee that any specific host will be available at the time of a scheduled session
- Peekabl does not endorse any specific view, opinion, recommendation, or advice expressed by a host during a live session
This acknowledgement does not affect your rights under applicable consumer protection law, including your right to a refund or credit where a technical failure on Peekabl's side prevents an experience from taking place, as described in Section 5.3.
4. Paid Services — Subscriptions, Pay-Per-View, and Credits/Stamps
4.1 Subscription Plans
Peekabl offers subscription plans that provide access to the platform and a defined number of experience Credits/Stamps per billing period. Available plans are described at sign-up and on your account dashboard.
Key subscription terms:
- Subscriptions are billed in advance on a recurring monthly or annual basis
- Your first subscription month may include a free trial period as specified at sign-up
- Credits/Stamps included in your subscription plan expire at the end of each billing period and do not roll over
- Credits/Stamps have no monetary value and cannot be transferred, gifted, or redeemed for cash
4.2 Pay-Per-View
Certain experiences on Peekabl are available on a pay-per-view basis. These are purchased individually and grant access to a specific session or experience. Pay-per-view purchases are processed immediately and access is granted at the time of the scheduled experience.
4.3 Private Virtual Tours
Private virtual tours — where a user books an exclusive session with a specific host — are a planned feature of the Platform and will be made available in a future update. The terms and pricing applicable to private sessions will be published on the Platform when this feature launches. Until that time, this section serves as notice of the intended feature only and does not create any contractual entitlement.
4.4 Payment Processing
Payments on Peekabl are processed by third-party payment service providers (currently Stripe). By making a purchase, you:
- Agree to provide accurate and complete payment information
- Authorise Peekabl to charge the payment method provided
- Agree to the applicable terms of the payment processor
Peekabl does not store your full card details. Payment data is handled by our payment processor in accordance with PCI DSS standards.
4.5 Pricing Changes
Peekabl reserves the right to modify pricing at any time. For subscription users, any price changes will take effect at the start of the next billing cycle, with at least 30 days' prior notice. Continued use of the Platform after a price change takes effect constitutes acceptance of the new pricing.
4.6 Taxes
Prices displayed on Peekabl are exclusive of VAT and any other applicable taxes. VAT is calculated and added at checkout based on your country of residence. Users outside the EU may be subject to local taxes or duties applicable in their jurisdiction, which are their own responsibility.
5. Cancellation and Refund Policy
EU consumer law gives you specific rights around cancellation and refunds. This section is designed to be fully compliant with those rights, including the Consumer Rights Directive and applicable Bulgarian consumer protection law.
5.1 Subscription Cancellation
You may cancel your subscription at any time through your account settings. Upon cancellation:
- Your subscription will remain active until the end of the current billing period
- You will not be charged for the following period
- Any unused Credits/Stamps at the time of cancellation will expire and will not be refunded
5.2 Right of Withdrawal — EU Users
If you are a consumer based in the EU or EEA, you have a statutory right to withdraw from a purchase contract within 14 days without giving a reason (the "cooling-off period"). This right applies to both subscription purchases and individual pay-per-view purchases.
However, EU consumer law provides that the right of withdrawal is lost for digital content and services once performance has begun, provided you gave your explicit prior consent and acknowledged that this would result in the loss of your withdrawal right.
For subscriptions: by requesting immediate access to the Platform at sign-up, you consent to the service beginning before the 14-day period expires and acknowledge that the right of withdrawal is lost from that moment.
For pay-per-view purchases: by completing a pay-per-view purchase and accessing or joining the experience, you consent to the digital content being delivered immediately and acknowledge that the right of withdrawal is lost upon that access.
In both cases, Peekabl will present a clear consent confirmation at the point of purchase before any charge is made. If you do not provide this consent, your access or experience will not begin until the 14-day cooling-off period has expired.
5.3 Refunds for Technical Failures
If a paid experience fails to take place due to a verified technical failure on the Peekabl side, you are entitled to either:
- A credit equivalent to the value of the experience, or
- A full refund to your original payment method within 14 business days
Refund requests related to technical failures must be submitted to support@peekabl.com within 7 days of the scheduled experience.
5.4 Non-Refundable Situations
Except as required by law or stated in section 5.3, the following are non-refundable:
- Subscriptions where access to the Platform has been used during the billing period
- Pay-per-view purchases where the experience was delivered as scheduled
- Credits/Stamps that have expired
- Any purchase where the account has been terminated for violation of these Terms
5.5 Host Cancellations
If a host cancels a scheduled experience with fewer than 24 hours' notice, affected users will receive a credit refund equivalent to the full price of the experience. Peekabl will make reasonable efforts to notify affected users as quickly as possible.
6. Conduct Standards — What Peekabl Requires of Everyone
Peekabl exists to enable genuine human connection across borders. That only works if every person on the Platform — whether user, host, or guest — behaves with respect and in good faith. This section sets the legal conduct standards that apply to everyone. Our Community Guidelines provide additional detail in plain language.
6.1 Zero Tolerance: Hate Speech and Content That Causes Harm
Peekabl has a zero-tolerance policy toward hate speech and content designed to cause harm. This applies to all participants on the Platform — hosts and users alike — and to all content whether delivered live, in chat, in reviews, or in any other format.
The following are strictly prohibited and will result in immediate account suspension or permanent termination, at Peekabl's sole discretion:
- Hate speech — content that attacks, degrades, or incites violence or discrimination against any person or group based on race, ethnicity, national origin, religion, gender, sexual orientation, disability, age, or any other protected characteristic
- Content that promotes, glorifies, or facilitates violence, terrorism, or self-harm
- Content that depicts, solicits, or promotes child sexual abuse or exploitation in any form
- Deliberate psychological harm — content specifically designed to distress, traumatise, or cause emotional harm to a viewer or participant
- Content that publicly shames, threatens, or humiliates any individual
- Misinformation or content that could cause serious real-world harm if believed
Peekabl reserves the right to terminate any live session immediately and without notice where such content is identified. Accounts involved in hate speech or harmful content will be permanently banned without refund.
Where required by applicable law, Peekabl will report illegal content to the relevant law enforcement or regulatory authorities.
6.2 General Prohibited Conduct
In addition to the zero-tolerance categories above, the following conduct is prohibited on the Platform:
- Harassing, threatening, bullying, or intimidating any host, user, or Peekabl representative
- Sharing sexually explicit or pornographic content
- Soliciting or engaging in any commercial transaction directly with a host or user outside of the Platform
- Recording, screenshotting, or capturing session content by any means without explicit consent
- Redistributing, reselling, or publicly broadcasting any Peekabl experience
- Attempting to access, probe, or compromise the security of the Platform or its infrastructure
- Using automated bots, scrapers, or scripts to access or interact with the Platform
- Engaging in fraud, including initiating chargebacks without valid basis or misusing the refund process
- Impersonating any person or entity
- Violating any applicable law or regulation in your use of the Platform
6.3 Obligations Specific to Hosts During Live Streams
Hosts have a particular responsibility given their role as content creators on the Platform. During any live session, hosts must not:
- Deliberately show, reference, or describe content that could cause harm, distress, or shock to viewers without prior warning
- Film in locations or situations where streaming could endanger themselves or third parties
- Make false or misleading statements about their location, identity, or the nature of the experience
- Solicit tips, payments, or personal contact information from users outside of the Platform
- Use a live session to promote competing platforms or direct users away from Peekabl
These obligations are detailed further in the Host Agreement, which all hosts must sign before going live.
6.4 Content Moderation
Peekabl operates a reactive moderation model for live content. This means:
- We cannot pre-screen live sessions before they begin
- We respond to reports from users and hosts and investigate promptly
- We reserve the right to terminate live sessions, remove recorded content, or take account action at any time where a violation is identified
If you witness conduct or content during a session that violates these Terms, please report it immediately using the in-Platform reporting tool or by emailing trust@peekabl.com. We take all reports seriously and will respond within 48 hours.
6.5 User-Generated Content
Where the Platform allows users to post content — including chat messages, reviews, or profile information — you are solely responsible for that content. By posting content, you confirm that it does not infringe third-party rights, does not violate these Terms, and is accurate and in good faith. Peekabl does not endorse user-generated content and reserves the right to remove any content that violates these Terms without notice.
6.6 License to User-Generated Content
By posting content on Peekabl, you grant Peekabl a non-exclusive, royalty-free, worldwide license to use, display, and reproduce that content for the purpose of operating and promoting the Platform. This license ends when you delete the content, except where it has already been incorporated into Platform materials.
7. Intellectual Property
7.1 Peekabl Intellectual Property
All content, software, trademarks, logos, design, and technology forming part of the Peekabl Platform are the exclusive property of CU DPK or its licensors. Nothing in these Terms grants you any ownership rights in Peekabl's intellectual property.
You are granted a limited, revocable, non-exclusive, non-transferable license to use the Platform for your personal, non-commercial use. You may not:
- Copy, reproduce, or distribute any part of the Platform or its content
- Modify, adapt, or create derivative works
- Reverse engineer or decompile any part of the Platform software
- Use Peekabl's brand, name, or logo without prior written consent
7.2 Host Content and Livestream Ownership
Hosts retain ownership of their original creative content. By conducting an experience on Peekabl, hosts grant Peekabl a non-exclusive license to stream, archive, and promote their content as described in the Host Agreement. Users acquire no ownership rights over any experience content they participate in.
7.3 Recording Prohibition
Unauthorised recording of any Peekabl experience is strictly prohibited. This includes screen recording, audio capture, or any other method of capturing live session content. Violations may result in immediate account termination and may expose the user to legal liability under applicable copyright law.
7.4 Feedback and Suggestions
If you provide feedback, suggestions, or ideas to Peekabl about the Platform, you grant Peekabl the right to use that input freely without compensation or attribution to you.
8. Privacy and Data Protection
Peekabl takes data protection seriously. We operate as a data controller under the EU General Data Protection Regulation (GDPR) and applicable Bulgarian data protection law.
Our Privacy Policy explains in full:
- What personal data we collect and how
- The lawful basis for each type of processing
- How long we retain data
- Your rights as a data subject
- How to contact us or lodge a complaint with a supervisory authority
By using Peekabl, you acknowledge that you have read and understood our Privacy Policy. The Privacy Policy is incorporated by reference into these Terms.
8.1 Data Controller Identity
CU DPK, registered in Bulgaria, is the data controller for all personal data collected through the Platform. Our designated contact for data protection matters is: legal@peekabl.com.
8.2 International Data Transfers
As a global platform, your data may be processed in countries outside the EU/EEA. Where this occurs, Peekabl ensures that appropriate safeguards are in place in accordance with GDPR requirements, including Standard Contractual Clauses where applicable.
9. Account Suspension and Termination
9.1 Your Right to Close Your Account
You may close your Peekabl account at any time by:
- Using the account deletion function in your account settings, or
- Submitting a written request to legal@peekabl.com
Upon account closure, your access to the Platform will be removed. Any unused subscription Credits/Stamps will expire. Data deletion will be handled in accordance with our Privacy Policy.
9.2 Peekabl's Right to Suspend or Terminate
Peekabl may suspend or terminate your account, with or without notice, if:
- You violate any provision of these Terms or our Community Guidelines
- We have reasonable grounds to believe your account has been used fraudulently
- You engage in conduct that causes harm to other users, hosts, or Peekabl
- We are required to do so by applicable law or a regulatory authority
Where possible, we will give you prior warning and an opportunity to remedy the breach before termination. For serious violations — including illegal activity, fraud, or safety risks — we may terminate immediately.
9.3 Effect of Termination
Upon termination:
- Your access to the Platform and all associated features will cease
- Any unused Credits/Stamps or subscription value remaining will not be refunded, unless required by law
- Any content you posted on the Platform may be removed
- Provisions of these Terms that by their nature should survive termination (including IP, liability, and dispute resolution clauses) will continue to apply
10. Liability and Disclaimers
EU consumer law imposes limits on what liability can be excluded in contracts with consumers. This section is drafted to respect those limits. We do not exclude liability where the law does not permit us to.
10.1 Platform Provided As-Is
Peekabl provides the Platform on an "as is" and "as available" basis. To the extent permitted by applicable law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that:
- The Platform will be uninterrupted, error-free, or free of viruses or harmful components
- The content of any experience will be accurate, complete, or suitable for your purposes
- Any technical defects will be corrected
10.2 Limitations on Our Liability
Subject to section 10.3, Peekabl's total liability to you for any claim arising out of or in connection with these Terms or the Platform will not exceed the total amount you paid to Peekabl in the 12 months preceding the event giving rise to the claim.
We will not be liable for:
- Indirect, incidental, or consequential loss
- Loss of profits, revenue, data, or business opportunity
- Loss arising from content posted by other users or hosts
- Technical failures of third-party services or infrastructure beyond our reasonable control
10.3 Liability We Cannot Exclude
Nothing in these Terms limits or excludes our liability for:
- Death or personal injury caused by our negligence
- Fraud or fraudulent misrepresentation
- Any liability that cannot be excluded under applicable EU or Bulgarian consumer protection law
- Breach of any statutory rights you have as a consumer under applicable law
10.4 Your Indemnification of Peekabl
You agree to indemnify and hold Peekabl, its directors, employees, and agents harmless from any claims, damages, or expenses (including reasonable legal fees) arising from:
- Your use of the Platform in violation of these Terms
- Content you post on the Platform that infringes third-party rights
- Your violation of any applicable law
11. Modifications to the Platform and These Terms
11.1 Changes to the Platform
Peekabl may update, modify, or discontinue any part of the Platform at any time, including features, pricing, and available experiences. Where a significant change affects your existing paid services, we will provide reasonable advance notice.
11.2 Changes to These Terms
We may update these Terms from time to time to reflect changes in law, our services, or business practices. When we make material changes, we will:
- Post the updated Terms on the Platform with a revised effective date
- Send you a notification via email or in-Platform notice at least 30 days before the change takes effect
If you do not agree with the updated Terms, you should close your account before the new Terms take effect. Continued use of the Platform after the effective date constitutes acceptance of the updated Terms.
12. Governing Law and Dispute Resolution
12.1 Governing Law
These Terms are governed by the laws of the Republic of Bulgaria, without regard to its conflict of law rules. Where you are a consumer residing in the EU, you also retain the protection of the mandatory consumer protection laws of your country of residence.
12.2 Informal Resolution
Before initiating any formal proceedings, we encourage you to contact us at legal@peekabl.com to try to resolve any dispute informally. We will make a genuine effort to resolve your concern within 30 days of receiving your complaint.
12.3 EU Online Dispute Resolution
If you are a consumer in the EU, you have the right to use the European Commission's Online Dispute Resolution (ODR) platform to resolve disputes with us. The ODR platform is accessible at: https://ec.europa.eu/consumers/odr
12.4 Jurisdiction
For disputes that cannot be resolved informally or through the ODR platform, the courts of the Republic of Bulgaria will have jurisdiction. If you are an EU consumer, you may also bring proceedings in the courts of the country where you reside.
13. Additional Terms for Users in the United States
If you are accessing Peekabl from the United States, this section applies to you in addition to all other provisions of these Terms. In the event of any conflict between this section and another section of these Terms, this section takes precedence for US-based users.
13.1 Applicability
These additional terms apply to any user accessing Peekabl from within the United States, regardless of whether Peekabl maintains a legal entity in the United States. By accessing the Platform from the United States, you agree to these additional terms.
13.2 Dispute Resolution — Binding Arbitration for US Users
If you are a US-based user, any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Platform that cannot be resolved informally under Section 12.2 will be resolved by binding individual arbitration, not in court.
The arbitration will be administered by JAMS (www.jamsadr.com) under its Streamlined Arbitration Rules for claims under $250,000, or its Comprehensive Arbitration Rules for larger claims. The arbitration will be conducted in English and may be conducted remotely by video conference, telephone, or written submissions at the consumer's election — you are not required to travel to any specific location to participate. The arbitrator's decision will be final and binding and may be entered as a judgment in any court of competent jurisdiction.
Arbitration costs: when you initiate arbitration against Peekabl, the only filing fee you are required to pay is $250, which approximates current court filing fees. Peekabl will pay all remaining JAMS filing fees, case management fees, and arbitrator professional fees. This arbitration agreement is reciprocal — it binds both you and Peekabl equally.
You may opt out of this arbitration agreement within 30 days of first accepting these Terms by sending written notice to legal@peekabl.com with the subject line: Arbitration Opt-Out. If you opt out, disputes will be resolved in accordance with Section 12.4 of these Terms.
13.3 Class Action Waiver
To the fullest extent permitted by applicable law, you and Peekabl each waive the right to participate in a class action, class arbitration, or any other representative proceeding. All disputes must be brought in your individual capacity only.
If a court or arbitrator determines that this class action waiver is unenforceable for a particular claim, that claim must be severed from arbitration and brought in court, while all other claims remain subject to individual arbitration.
13.4 Limitation Period for US Claims
Any claim or cause of action arising out of or related to these Terms or your use of the Platform must be filed within one (1) year of the date the claim arose. Claims not filed within this period are permanently barred. This limitation applies regardless of any statute of limitations that would otherwise apply under applicable state or federal law.
13.5 California Users — Additional Privacy Rights
If you are a California resident, you have additional rights under the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA). These rights include:
- The right to know what personal information Peekabl collects about you and how it is used and shared
- The right to delete personal information we have collected from you, subject to certain exceptions
- The right to correct inaccurate personal information we hold about you
- The right to opt out of the sale or sharing of your personal information — Peekabl does not sell your personal information
- The right to limit the use of sensitive personal information
- The right not to be discriminated against for exercising your privacy rights
To exercise any of these rights, please contact us at legal@peekabl.com or as described in our Privacy Policy. We will respond to verified requests within 45 days as required by California law.
13.6 Other US State Privacy Rights
Residents of Virginia, Colorado, Connecticut, Texas, and other US states with applicable privacy laws may have similar rights to those described in section 13.5. Peekabl respects and honours these rights regardless of the specific state threshold requirements. Please contact legal@peekabl.com to exercise any applicable state privacy rights.
13.7 Video Privacy Protection Act (VPPA)
Peekabl is a video streaming platform and acknowledges its obligations under the federal Video Privacy Protection Act (VPPA). Peekabl does not knowingly disclose personally identifiable information about your video viewing activity to any third party without your express written consent, except as required by law or as described in our Privacy Policy. If you believe your VPPA rights have been violated, please contact legal@peekabl.com.
13.8 FTC Compliance
Peekabl operates in compliance with the US Federal Trade Commission Act. We do not engage in unfair or deceptive acts or practices in connection with the Platform. Our Terms, Privacy Policy, and all platform communications accurately represent how the Platform operates and how your data is handled. If you believe Peekabl has engaged in a deceptive or unfair practice, you may report it to the FTC at ftc.gov/complaint in addition to contacting us directly.
13.9 Governing Law for US Disputes
For US-based users, disputes resolved through arbitration under section 13.2 will be governed by the Federal Arbitration Act and, where applicable, the laws of the State of Delaware, without regard to conflict of law principles. This choice of law does not deprive you of any mandatory consumer protections available under the laws of your state of residence.
14. Miscellaneous
14.1 Entire Agreement
These Terms, together with our Privacy Policy, Cookie Policy, Community Guidelines, and Payment and Refund Policy, constitute the entire agreement between you and Peekabl with respect to your use of the Platform.
14.2 Severability
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions will continue in full force and effect.
14.3 No Waiver
Peekabl's failure to enforce any right or provision in these Terms does not constitute a waiver of that right or provision.
14.4 Assignment
You may not assign or transfer your account or rights under these Terms to any third party. Peekabl may assign its rights and obligations under these Terms in connection with a merger, acquisition, or sale of assets, with notice to you.
14.5 No Agency or Partnership
Nothing in these Terms creates an employment, agency, partnership, or franchise relationship between you and Peekabl.
14.6 Force Majeure
Peekabl will not be liable for any failure or delay in performance caused by circumstances beyond our reasonable control. For a live streaming platform, such circumstances include but are not limited to:
- Adverse weather conditions affecting the host's location — including storms, flooding, extreme heat or cold, or other natural events that prevent a host from streaming
- Loss of power or internet connectivity at the host's location
- Technical failures of third-party streaming infrastructure, content delivery networks, or cloud hosting providers
- Device failure or technical malfunction at the host's end that prevents or interrupts the stream
- Acts of God, natural disasters, fire, or flood
- Government action, legal prohibition, public health emergencies, or pandemic
- Widespread internet infrastructure outages or cybersecurity incidents affecting network availability
Where a force majeure event causes a scheduled experience not to take place, Peekabl will make reasonable efforts to notify affected users promptly, issue Credits/Stamps in accordance with Section 5.5, and help facilitate rescheduling where the host is willing and able to do so. Force majeure events do not affect your statutory rights under applicable consumer protection law.
14.7 Language
These Terms are provided in English. Where a translated version is made available, the English version will take precedence in case of any conflict.
14.8 Notices
Any legal notices, formal complaints, or communications required under these Terms should be sent to Peekabl in writing by email to legal@peekabl.com. Peekabl will deliver notices to you via the email address associated with your account, via in-Platform notification, or via any other contact method you have provided. Notices are deemed received on the date they are sent by email or displayed on the Platform, unless there is evidence of non-delivery. It is your responsibility to keep your contact information current in your account settings.
14.9 Survival
The following sections of these Terms survive termination or expiry of your account and continue to apply after your account is closed: Section 3.7 (Assumption of Risk), Section 7 (Intellectual Property), Section 8 (Privacy and Data Protection), Section 10 (Liability and Disclaimers), Section 12 (Governing Law and Dispute Resolution), Section 13 (Additional Terms for Users in the United States), and this Section 14 (Miscellaneous). Survival does not extend any right you may have to use the Platform after termination.
14.10 Public Content After Account Closure
Where you have posted public content on the Platform — including reviews or ratings of hosts or experiences — that content may remain visible to other users after your account is closed. This is because such content forms part of the trust infrastructure of the Platform. We will anonymise your public content upon your written request to legal@peekabl.com where technically feasible. This does not affect your right to erasure under GDPR or applicable privacy law, which is addressed in our Privacy Policy.
